CapX Funding – Terms and Consent Agreement

1. Introduction & Consent

By proceeding with your application, you confirm that you have read, understood, and agree to these Terms and Consent provisions. You authorise CapX Funding  our affiliated companies, and authorised agents (“we”, “us”, “our”) to collect, use, and share your personal information in accordance with this Terms and Consent document, our Privacy Policy, and applicable privacy and credit laws in Australia and New Zealand.

2. Collection and Use of Personal Information
You consent to us collecting personal and financial information about you for the following purposes: assessing your application for commercial credit, verifying your identity and background, communicating with you about your application or finance product, direct marketing of products or services (unless you opt out), and complying with legal obligations, including anti-money laundering and counter-terrorism laws. We will retain this information for the purpose it was collected and manage it in accordance with our Privacy Policy. If you do not provide certain information, we may not be able to proceed with your application.
3. Credit Checks and Reporting Authority

You authorise CapX Funding and its partners to seek and use personal credit information from credit reporting bodies, request rental history or landlord verification where applicable, obtain credit reports from third-party credit bureaus to evaluate your creditworthiness, and disclose personal and commercial credit information about you to credit reporting bodies. This information may include, but is not limited to: your full name, date of birth, and address; details of any credit applied for or provided; your repayment history, default records, or dishonoured payments; serious credit infringements or insolvency actions, if applicable; and confirmation that your credit obligations have been fulfilled.

4. Disclosure of Information
We may disclose your information to third parties involved in the finance process (such as credit providers, insurers, underwriters, and brokers), to our legal, financial, and IT service providers (including cloud-based or overseas providers), if required by law or regulatory authorities, or in the event of a business sale, merger, or asset transfer.
5. Bank Statement Access via Third-Party Technology
You authorise us and our trusted third-party service providers to securely retrieve your bank transaction data directly from your financial institution for assessment purposes. This may include your most recent six months of transaction history and ongoing access to bank data for monitoring or future application reassessments. By continuing, you appoint our third-party technology provider as your authorised agent solely for this purpose, acknowledging that this access does not violate your bank’s terms and conditions.
6. Identity Verification
You consent to us using electronic means, including data from credit reporting agencies, to verify your identity. If you prefer an alternative method of verification, please contact us directly.
7. Communication and Electronic Documents
You agree to receive documents and notices electronically, including credit contracts and loan agreements, account statements and repayment schedules, statutory disclosures (such as the Information Statement and Credit Guide), and any other required documents relating to your funding. We may provide these documents via email, SMS, or a secure customer login area on our website. You acknowledge that it is your responsibility to check your nominated email and mobile regularly for notifications. You may withdraw this consent at any time by contacting us and providing an alternative means of communication.
8. Marketing Consent
Unless you opt out, you consent to us using your personal information to send marketing communications about products, services, offers, or promotions. You can opt out at any time by contacting us or using the unsubscribe link in communications.
9. Your Rights
You have the right to access and request correction of any personal information we hold about you. You may also withdraw any of the consents provided in this document or make a complaint if you believe your privacy has been breached. Complaints will be handled in accordance with our Privacy Policy.
10. Governing Law
This agreement is governed by the laws of New South Wales and applicable Australian consumer and privacy laws.

Any such information collected will be handled in accordance with CapX Funding’s Privacy Policy and consent guidelines, which govern its collection, use, and disclosure.
